BurstReps Terms of Service

Article 1. Purpose

These Terms set out the rights and responsibilities of BurstReps (the “Company,” “we,” or “us”) and members who use the BurstReps app, website, and connected services (the “Service”).

Article 2. Definitions

  1. “Member” means a person who accepts these Terms, creates an account, and uses the Service.
  2. “Records” means meal, workout, body, health, goal, schedule, and related information entered, uploaded, connected, or generated through the Service.
  3. “AI Coach” means the AI feature that produces responses from a member’s messages and available Records and can carry out Record- or plan-related actions in the Service.
  4. “Member Content” means text, photos, files, Records, feedback, and other material a member enters or uploads.
  5. “Pro” means the set of features offered through a paid subscription.

Article 3. Availability, acceptance, and changes

  1. We make these Terms and our Privacy Policy easy to find on the sign-up screen or within the Service.
  2. The service agreement begins when a member reviews and accepts these Terms and the Privacy Policy in the sign-up or sign-in process and then uses the Service.
  3. We may change these Terms within the limits of applicable law. We ordinarily announce changes and their effective date at least seven days beforehand.
  4. We ordinarily give at least 30 days’ clear advance notice of important or unfavorable changes. We obtain separate consent where the law requires it.
  5. If a member does not accept revised Terms, they may end the agreement and close their account.

Article 4. Eligibility and accounts

  1. You must be at least 14 years old to use the Service.
  2. Provide accurate, current information and do not use someone else’s account or information.
  3. Keep your device and account secure. Report suspected account compromise or unusual activity promptly to company@burstreps.com.
  4. We may reject an application or restrict an account where there is a serious risk of unlawful conduct, infringement of others’ rights, misuse, or harm to Service security.

Article 5. Service features

We may provide some or all of: meal, workout, body-change, and health-related logging; recognition of food and nutrition-label photos, food search, saved meals, and repeat logging; programs, scheduled workouts, and management of sets, loads, reps, RPE, and rest; goal, schedule, trend, and analysis features; Apple Health or Health Connect connections; AI Coach conversations and Record- or plan-related actions; notifications, exports, subscriptions, and related features. Availability may vary by OS, device, country, subscription, or permission setting.

Article 6. What AI Coach is—and is not

  1. AI Coach responses are generated probabilistically. They can be inaccurate, incomplete, or contrary to your intent, and similar inputs can produce different results.
  2. We do not guarantee that AI responses are complete, accurate, current, or fit for a particular purpose. Check important Records and results before relying on them.
  3. AI Coach does not replace a doctor, dietitian, physiotherapist, or other qualified professional and does not provide medical care, diagnosis, treatment, or emergency services.
  4. If you experience pain, injury, breathing difficulty, chest pain, altered consciousness, or another concerning symptom—or need medical judgment—do not rely on AI Coach. Stop exercising where appropriate and seek professional or emergency help.
  5. We may change the AI provider or feature configuration. We will reasonably notify members of changes that materially affect the Service.

Article 7. AI Coach actions on Records and plans

  1. Based on your input, Service context, and available Records, AI Coach may access, create, add, change, delete, or mark as completed Records or plans relating to workouts, meals, the body, goals, and schedules.
  2. For example, it may adjust the exercises, sets, or targets in a scheduled workout, replace an exercise in an active workout, add a meal record, or prepare a later plan.
  3. AI Coach may misunderstand your intent or act on the wrong item, number, or date. Review its actions and updated Records. You can correct or delete them in the app or ask AI Coach or us for a correction.
  4. We display action results in the app or conversation where possible. Network, outside-service, or synchronization issues may delay display.
  5. If we introduce AI decisions that have legal or similarly significant effects without human involvement, we will provide the notices and rights required by applicable law.

Article 8. Health and exercise information

  1. Information about calories, nutrition, training volume, loads, recovery, body changes, or goals is a reference for logging and general fitness management.
  2. Sensors, photo recognition, food databases, member input, and AI output may contain measurement or estimation errors.
  3. If you are pregnant, have a medical condition or injury, take medication, have an eating disorder, or need special nutrition or exercise restrictions, consult a qualified professional before acting on a plan generated with the Service.
  4. Use the Service safely in light of your health and exercise environment.

Article 9. Sensitive information and external connections

  1. Apple Health and Health Connect connections are optional. Review both the OS permission screen and our separate Health Data Consent before connecting.
  2. You can change OS permissions in device settings. To withdraw BurstReps’s processing consent or delete information already stored by us, use the available app controls or email company@burstreps.com.
  3. External outages, policy changes, or permission restrictions may interrupt a connection.

Article 10. Member Content

  1. You or the rightful owner retain rights in Member Content.
  2. You permit us to store, reproduce, transform, analyze, and process Member Content only as needed to provide, protect, and operate the Service and coaching; assess the quality, errors, and safety of AI features; and improve prompts, algorithms, and Service features. Our Privacy Policy and applicable law limit this use.
  3. This is a non-exclusive permission limited to what is necessary for the Service. It does not transfer ownership of Member Content to us.
  4. We seek separate optional consent, explaining purpose, channel, and duration, before using an identifiable member’s photo, conversation, progress story, or Records in advertising or promotion.
  5. You must have the right to provide your content and must not infringe law or others’ rights.

Article 11. Your responsibilities and prohibited conduct

Do not impersonate others or misuse their accounts or personal information; enter false information or process another person’s health, body, meal, or workout information without authority; use the Service or AI features for unlawful, harmful, discriminatory, harassing, fraudulent, or rights-infringing purposes; disrupt operations with malware, excessive automation, or abnormal traffic; evade security, use, payment, or access controls; reverse-engineer the Service outside what law permits or infringe intellectual-property rights; impersonate a medical professional or present AI output as a verified diagnosis or prescription; or otherwise violate law, public order, or these Terms.

Without our prior permission, you must not collect, extract, or process AI responses or outputs from the Service for use or provision as data to train, fine-tune, or distill another AI, or to reproduce or imitate the Service.

This restriction does not prohibit you from exporting your own Records or using your Records and AI responses with another service for personal health and fitness analysis. This permission does not extend to using or providing AI responses or outputs as data to train, fine-tune, or distill another AI. The restriction does not apply to uses that cannot be restricted under applicable law.

Article 12. Pro subscription, payment, and cancellation

  1. The purchase screen shows Pro pricing, term, any free trial, and included features.
  2. Apple App Store, Google Play, or another platform you use may process subscription payments. Payment methods and billing timing follow that platform’s rules.
  3. Recurring subscriptions renew for the period shown at purchase. Cancel auto-renewal through the relevant platform’s subscription-management screen before the next billing date.
  4. Canceling a subscription stops the next renewal. Ordinarily, Pro remains available through an already-paid term.
  5. Refunds follow applicable law and the policy of the platform that processed your payment. These Terms do not limit statutory cancellation or refund rights.
  6. Closing your BurstReps account may not cancel an app-store subscription. Check your Apple App Store or Google Play subscription and cancel it there if needed before closing your account.
  7. We may change prices or subscription features, with advance notice for changes affecting existing billing as required by platform policy and law.

Article 13. Changes and interruptions

  1. We may change some or all of the Service for operational or technical reasons, or in response to law or changes in external services.
  2. We give reasonable advance notice of material changes or termination where possible. For a security incident, urgent outage, or immediate legal requirement, notice may follow the action.
  3. Natural disasters, network failures, cloud or AI provider outages, app-store outages, urgent maintenance, or events beyond our reasonable control may temporarily interrupt the Service.

Article 14. Restrictions

  1. If a member violates these Terms or law, or materially threatens the Service’s safety or operation, we may issue a warning, restrict a feature, suspend access, or end the agreement.
  2. Where possible, we give the reason, duration, appeal method, and an opportunity to respond.
  3. We may restrict access first and notify the member afterward if urgent security risks, infringement of others’ rights, or law require immediate action.

Article 15. Account closure

  1. You may end the agreement and close your account through the app’s withdrawal feature or by contacting company@burstreps.com.
  2. Account closure and paid-subscription cancellation are separate. Check your app-store subscription as described in Article 12(6) before closing the account.
  3. Once withdrawal is complete, we immediately begin deletion of account-linked personal information and delete it without undue delay under our Privacy Policy. We segregate legally required records and delete them when their retention period ends.
  4. Deleted Records and content may be unrecoverable. Use any available export feature before closing the account if you need a copy.

Article 16. Intellectual property

  1. Rights in the Service’s software, design, trademarks, logos, databases, and our original content belong to us or their rightful owners.
  2. We give you a personal, non-exclusive, non-transferable right to use the Service while you are a member.
  3. Rights in and permitted uses of AI-generated material may depend on the input, applicable law, and AI providers’ terms. We do not guarantee that generated material is free of third-party rights; check before publishing or using it commercially.

Article 17. Responsibility and limitations

  1. We exercise reasonable care to provide the Service and protect personal information under these Terms and applicable law.
  2. We are responsible under applicable law for harm caused by our intentional or negligent acts.
  3. We are not responsible to the extent the law does not hold us responsible for harm caused by a member’s own acts, inaccurate information they provided, reliance on AI output without checking it, or events beyond our reasonable control.
  4. Even for free features, this Article does not exclude liability for intentional acts, gross negligence, breach of privacy obligations, or liability that law does not permit us to exclude.
  5. Nothing here limits statutory consumer rights.

Article 18. Notices

We may notify you through in-Service messages, push notifications, your registered email, or the website. We may post notices that apply to many members in the Service or on the website.

Article 19. Privacy

Our processing of personal information is described in our Privacy Policy and separate Health Data Consent.

Article 20. Governing law and disputes

  1. These Terms are interpreted under the laws of the Republic of Korea, except to the extent mandatory laws in your place of residence require otherwise.
  2. We and the member will try in good faith to resolve Service disputes amicably.
  3. If a dispute is not resolved by discussion, it may be brought before a court with jurisdiction under applicable civil-procedure law. Nothing here removes a forum or remedy that mandatory consumer law gives you.
